Terms of Service

These Terms of Service ("Terms") govern your use of the Plus WorldBike mobile application and related services (the "App"). The App is provided by Plus WorldBike — Andrej Pajonk, Switzerland ("Plus WorldBike", "we", "us", "our"). Please read these Terms carefully.

By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App. Your use of the App is also governed by our Privacy Policy.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) and able to form a binding contract to use the App. By using the App you confirm that you meet these requirements.

2. Your account

You are responsible for the information you provide and for keeping your login credentials secure.
You are responsible for all activity that happens under your account.
Notify us promptly at plus-worldbike@gmail.com if you suspect unauthorised use of your account.
One person, one account. Do not impersonate others or create accounts for abusive purposes.

3. Acceptable use

When using the App — including teams, chat, comments and the marketplace — you agree not to:

Break any law or infringe anyone's rights;
Post content that is illegal, harmful, hateful, harassing, deceptive, sexually explicit or spam;
Upload viruses or attempt to disrupt, reverse‑engineer, scrape or gain unauthorised access to the App;
Falsify ride data or otherwise cheat the leaderboards (see Section 5);
Use the App to harass, stalk or endanger other riders.

We may remove content and suspend or terminate accounts that violate these Terms.

4. User content

You keep ownership of the content you create or upload (rides, photos, messages, listings, profile info — "User Content"). By posting User Content, you grant Plus WorldBike a worldwide, non‑exclusive, royalty‑free licence to host, store, display and distribute it solely to operate and provide the App (for example, showing your shared rides to teammates or your listing in the marketplace). You are responsible for your User Content and confirm you have the rights to post it.

5. Leaderboards & fair play

Leaderboards and challenges rely on honest ride data. Do not submit rides recorded by car, e‑bike (where prohibited), GPS spoofing, or any other manipulation. We may review, adjust, exclude or reset standings, and remove accounts that manipulate results, at our discretion.

6. Marketplace

The marketplace lets riders list and discover bikes and gear. Plus WorldBike is only a platform — we are not a party to any transaction between users. We do not own, inspect, guarantee or take responsibility for listed items, their condition, legality, pricing, or for any payment or delivery arranged between users. You deal with other users at your own risk. Meet safely, verify items, and comply with applicable laws.

7. Health, safety & assumption of risk

Cycling involves inherent risks. You use the App and ride entirely at your own risk.

Always obey traffic laws, wear appropriate safety equipment, and pay full attention to your surroundings — do not operate the App while it is unsafe to do so.
The App is for recreational and informational purposes and is not medical, fitness or navigational advice. Consult a professional before starting any training.
Routes, maps and weather are provided for convenience and may be inaccurate or out of date; do not rely on them as your only source for safety or navigation.
You are solely responsible for your own safety and for assessing whether conditions are safe to ride.

8. GPS & data accuracy

Location, distance, speed, elevation and weather data depend on your device's sensors and third‑party services and may contain errors. We do not guarantee the accuracy, completeness or availability of any data in the App.

9. Intellectual property

The App, its name, logo, design and software are owned by Plus WorldBike and protected by intellectual‑property laws. We grant you a limited, personal, non‑transferable, revocable licence to use the App for its intended purpose. You may not copy, modify, distribute or create derivative works from the App except as permitted by law.

10. Third‑party services

The App relies on third‑party services — including Google Firebase, Google and Apple sign‑in, map‑tile providers and weather providers. Your use of those services may also be subject to their own terms. We are not responsible for third‑party services.

11. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted or error‑free operation, to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, Plus WorldBike and its operator shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, or for personal injury or property damage arising from your use of (or inability to use) the App, the marketplace, or any ride. Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for death or personal injury caused by negligence, or mandatory consumer rights).

13. Indemnification

You agree to indemnify and hold harmless Plus WorldBike from any claims, damages or expenses arising from your User Content, your use of the App, your marketplace dealings, or your breach of these Terms.

14. Suspension & termination

You may stop using the App and delete your account at any time (Profile → Settings → Delete account). We may suspend or terminate your access if you breach these Terms or to protect the App or its users. Sections that by their nature should survive termination (e.g. content licence, disclaimers, liability, governing law) will continue to apply.

15. Changes to the App and Terms

We may update, change or discontinue features of the App, and we may update these Terms from time to time. We will post the new version here and update the "Last updated" date; material changes will be communicated in the App. Continued use after changes means you accept the updated Terms.

16. Governing law & disputes

These Terms are governed by the laws of Switzerland, without regard to conflict‑of‑law rules. The courts at the operator's domicile in Switzerland have jurisdiction, unless mandatory law in your country of residence (for example, EU consumer‑protection rules) grants you the right to bring proceedings, or requires application of the law, of your home country.
